THE BOTTOM LINE
- Prolonged Uncertainty: Significant delays in family reunification visa processing by Dutch authorities are creating prolonged uncertainty for highly-skilled migrants, key employees, and their employers.
- A Clear Legal Remedy: A recent court ruling confirms that taking legal action is an effective strategy to compel a decision. Courts are now imposing strict, new deadlines on the immigration service.
- Financial Penalties Enforced: The government now faces daily financial penalties (€100 per day, up to a maximum of €15,000) for failing to meet these court-ordered deadlines, signaling growing judicial impatience with systemic backlogs.
THE DETAILS
This case centered on an applicant for a provisional residence permit—a crucial step in family reunification—who faced excessive delays from the Dutch Minister for Asylum and Migration. After the standard 90-day decision period and a subsequent three-month extension had passed with no response, the applicant issued a formal notice of default. When the Minister still failed to act, the applicant elevated the matter to the courts, seeking a resolution to the administrative silence that was putting their family’s future on hold.
The District Court of The Hague ruled decisively in the applicant’s favor, declaring the appeal well-founded. Citing established precedent from higher courts, the judge affirmed that the systemic delays plaguing family reunification applications for asylum permit holders constitute “special circumstances.” This legal classification is significant because it empowers the judiciary to move beyond simply acknowledging the delay and instead intervene directly by setting a new, non-negotiable deadline for the government to fulfill its obligations.
As a result, the court has mandated that the Minister must issue a final decision on the application within eight weeks. This deadline can only be extended to twenty weeks if the Minister formally decides that a “further investigation” is required. To ensure compliance, the court attached a powerful incentive: a penalty payment of €100 for each day the new deadline is missed, capped at €15,000. This ruling provides a clear and enforceable timeline for businesses and employees, offering a potent legal tool to cut through administrative backlog and gain certainty.
