The Supreme Court’s decision outlines a clear and simple procedural failure. The court’s registrar sent a registered letter to the company, formally notifying them that the filing fees were due and providing a four-week deadline for payment. Postal tracking data confirmed the company received this notice. When the deadline passed without payment, the registrar sent a second registered letter, offering a final opportunity to either pay the fee or provide a reason for the delay. This final notice was also received but went unanswered.
Under Dutch law (specifically Article 8:41 of the General Administrative Law Act), the timely payment of court fees is a strict precondition for an appeal to be considered admissible.
